Welcome to Health Consultations. These Terms of Service (the "Terms") are an agreement between you and Health Consultations ("we", "us", or "our") covering your use of the website at wellness-consultations.com (the "Site"), our consulting services, and any products we sell, including The Book of Growth. By using the Site, contacting us to start an engagement, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. Who we are and scope

Health Consultations is a marketing and growth consultancy for health and wellness businesses. We work remotely with clinics, practitioners, brands, and teams to help them position, market, and grow. We also publish and sell The Book of Growth, a printed field guide for wellness businesses.

Everything we provide, whether through consulting, the Site, or our publications, is business, marketing, and educational material only. It is not medical, legal, financial, tax, or regulatory advice, and it is not a substitute for advice from a qualified professional in those fields. You are responsible for your own decisions and for meeting any regulatory or compliance obligations that apply to your business.

These Terms apply to everyone who uses the Site. Some sections apply specifically to consulting clients (section 2) or to product buyers (sections 3 and 4).

2. Consulting services and engagements

Our consulting work usually begins with a conversation and a written proposal. The specific scope, deliverables, timeline, fees, and payment schedule for any engagement are set out in that proposal or in a separate written agreement, which will control if anything in it differs from these Terms.

• Proposals and quotes. Any quote, estimate, or proposal we give is provided in writing and is valid for the period stated in it. A booking is confirmed once we both agree the scope in writing and any required deposit has been paid.
• Your cooperation. Good results depend on timely access to the information, accounts, approvals, and people we need from your side. Delays on your side may affect timelines and fees.
• No guaranteed business outcomes. We bring experience, method, and effort. We do not and cannot guarantee specific revenue, leads, rankings, conversion rates, or other business results, because those depend on many factors outside our control, including your market, offer, budget, and execution.
• Independent contractor. We act as an independent consultant. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between us.

3. The Book of Growth and other products

The Book of Growth is a compact printed softcover field guide (about 140 pages) that distills the growth playbook we use with clients, covering positioning, offers, funnels, email, content, and channel strategy for health and wellness businesses. It is sold individually or in bulk for clinics, teams, and resellers.

We use a simple concierge ordering process rather than an automated checkout:

• Orders are requests. When you submit an order form on the Site, you are asking to buy. Your order is an offer, not a completed sale. A contract is formed only when we confirm your order.
• How we confirm and take payment. No card details are taken on the Site. After you submit your request, we email you back to confirm availability and shipping, along with a secure payment link. Your order is complete once payment through that link is received.
• Title and risk. Ownership of, and responsibility for, the physical copies passes to you once we have received full payment and handed the copies to the carrier for delivery.
• Availability. We may decline or cancel an order, for example if an item is unavailable or if there is an error in the price or description. If we cancel an order you have already paid for, we will refund it.
• Delivery, returns, and refunds. Shipping timeframes, returns, and refunds are covered in our Refund & Shipping policy, which forms part of these Terms.

4. Pricing and payment

• Currency. All prices are shown and charged in US dollars unless we clearly state otherwise.
• Introductory pricing. Some prices, including the bulk tiers for The Book of Growth, are introductory and may change at any time. The price that applies to your order is the one we confirm to you in writing when we accept it.
• Taxes and duties. Prices exclude any taxes, customs duties, or import charges unless stated. Where these apply, they may be added to your total or, for cross-border shipments, collected by the carrier or authorities on delivery. Any such charges are your responsibility.
• Payment. Product payments are made through the secure payment link we send. Consulting fees are invoiced and paid as set out in your engagement agreement.

5. Intellectual property

The Site, its design and text, The Book of Growth, and all other materials we create, including frameworks, templates, and written deliverables, are owned by Health Consultations or its licensors and are protected by copyright and other rights. We grant you a limited, personal, non-transferable license to use what you buy, subject to the following.

• The Book of Growth. When you buy a copy, you may use it for your own personal or internal business purposes, including sharing the physical book with your own team. You may not copy, reproduce, resell, republish, or redistribute its contents, in whole or in part, in any format.
• Bulk buyers. If you buy copies in bulk, you may give or provide the physical copies you purchased to your staff, clients, or members. This right covers the physical copies only. It does not allow you to scan, reprint, or otherwise reproduce the content.
• Consulting deliverables. Ownership and license of any custom deliverables we create for you are set out in your engagement agreement. Unless that agreement says otherwise, our underlying methods, know-how, and templates remain ours.
• Trademarks. "Health Consultations", "The Book of Growth", and our logo are our marks. You may not use them without our written permission.

6. Acceptable use of the website

You agree to use the Site lawfully and reasonably. In particular, you agree not to:

• use the Site in any way that breaks the law or infringes anyone's rights;
• copy, scrape, harvest, or systematically extract content from the Site except as normal browsing requires;
• attempt to gain unauthorized access to the Site, its servers, or any connected systems;
• upload or transmit any virus, malware, or harmful code, or otherwise interfere with the Site's operation;
• submit false information through our forms, or use the forms to send spam or abusive content.

We may suspend or restrict access to the Site if we reasonably believe these Terms are being broken.

7. Disclaimers and no guarantee of results

The Site and its content are provided on an "as is" and "as available" basis. While we work hard to keep information accurate and useful, we do not warrant that the Site will be uninterrupted, error free, or that the content is complete or current.

Our consulting, the Site, and The Book of Growth share ideas and methods that have worked for us and our clients. They are educational and strategic in nature. We do not guarantee any particular business, financial, or marketing result. Outcomes depend on factors specific to you, including your market, offer, resources, timing, and how you apply the material. Nothing here is medical, legal, financial, or tax advice, and you should seek qualified professional advice where appropriate.

8. Limitation of liability

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by negligence, or for fraud.

Subject to that, to the fullest extent permitted by law:

• we are not liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, revenue, business, goodwill, or data, arising from your use of the Site, our services, or our products;
• our total liability to you for all claims connected with a given product order or consulting engagement will not exceed the amount you paid to us for that order or engagement.

9. Indemnity

You agree to indemnify and hold harmless Health Consultations and the people who work with us from any claims, losses, and reasonable costs (including legal fees) that arise from your misuse of the Site, your breach of these Terms, or your infringement of someone else's rights, including your use or distribution of our materials in a way these Terms do not permit.

10. Third-party links and services

The Site and our communications may link to or rely on third-party websites and services, for example our payment provider, email tools, or scheduling tools. We do not control those third parties and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by that party's own terms and privacy policy. When you pay through the secure link we send, your payment is handled by our payment provider under their terms.

11. Governing law and disputes

These Terms and any dispute arising from them or from your use of the Site, our services, or our products are governed by the laws of [Governing law jurisdiction], without regard to conflict-of-law rules. You and we agree to submit to the courts of [Governing law jurisdiction] for any dispute, unless mandatory law where you live gives you the right to bring a claim elsewhere.

12. Changes to these terms

We may update these Terms from time to time, for example to reflect changes to our services, products, or the law. When we do, we will change the "Last updated" date at the top of this page. The version in force when you place an order or start an engagement is the one that applies to it. For ongoing use of the Site, continuing to use it after we post an update means you accept the updated Terms.
